Determining Custody: Child's Best Interest

In determining child custody where there hasn't been a permanent custody order by the court, the court will analyze the following factors in deciding what custody arrangement is in the best interests of the child (California Family Code Section 3011:



  • The health, safety, and welfare of the child.  
  • History of physical abuse against either the child, spouse or partner.  
  • History of drug or alcohol abuse.
  • Contact with parents (for example:  does either parent show an interest in frequent contact with children?)
  • The court will consider the stability and continuity of the environment that the child is currently in.
